Terms of Service
Who may use Shvasa (adults only), your membership and how to cancel, practising at your own risk, the camera features, our content, and how disputes are resolved.
Please read these Terms carefully. They include a release of claims for injuries that are an ordinary part of physical activity (section 4), a limit on our liability (section 18) and, if you live in the United States, an agreement to resolve disputes individually by binding arbitration and to give up class actions and jury trials, with a right to opt out (section 20).
1. Who we are and what this is
Shvasa is a virtual yoga studio operated by buildteam.ai (“Shvasa”, “we”, “us”). These Terms are a contract between you and us and govern your use of the Shvasa website, the Shvasa apps and everything we provide through them (the “Service”). You accept them when you tick the box agreeing to them, create an account, or use the Service. The Privacy Policy, the Health and Safety Notice, Cancellation and refunds and the Acceptable Use policy form part of these Terms. If you do not agree, do not use the Service.
2. Adults only
Shvasa is for adults. You must be at least 18 years old, and the age of majority where you live if that is higher, to create an account, buy anything, or practise. By agreeing to these Terms you confirm that you are. Our classes are designed for adult bodies and are not suitable for children: do not let anyone under 18 practise with Shvasa, use your account, or appear in front of the camera features. We may ask you to confirm your age and close any account we reasonably believe belongs to someone under 18.
Your account is personal to you. Keep your sign-in method secure and tell us at once if you think someone else has used it. You are responsible for everything done through your account. Other adults may practise alongside you; each of them practises at their own risk under these Terms, and you agree to tell them so.
3. Not medical advice
Shvasa provides yoga instruction for general wellbeing. It is not medical advice, diagnosis, treatment or therapy, and no part of the Service, whether a class, a teacher’s words, a program for a condition, a suggestion or a measurement, replaces your clinician. Using Shvasa does not create a doctor–patient, therapist–client or other professional relationship with us or our teachers. Read the Health and Safety Notice before you begin and check with your clinician first if anything in it applies to you.
4. Practising at your own risk
Yoga is physical activity and, like any exercise, carries a risk of injury, including strains, sprains, falls and, rarely, more serious harm. Our teachers are not in the room with you. You choose whether, when, where and how to practise, which postures to attempt and how far to go, and you are responsible for your space, your equipment and your own body. You agree that you take part voluntarily and accept the risks that are an ordinary part of practising yoga at home.
Guidance is not supervision. Some features see or hear more of your practice: a live session, where a teacher teaches at a set time and may see you if you turn your camera on; the coach in the iPhone app, which may speak a cue about a posture (such as “step a little wider”) from what your camera sees and the body setup you gave it; and the review of a class you practised with your camera, which an AI model makes and a teacher may also look at. All of these are general guidance from a distance. They are not supervision, a spotter, a safety check or a medical opinion; they can miss things, be late or be wrong, and they cannot tell how a posture feels to you. Stopping, resting and listening to your body always come first: if a cue does not feel right, ignore it. A live session’s video room may be run by a third-party service under its own terms.
Practising with a disability, an injury or a condition. Shvasa is for everyone who wants to practise, including people with a disability, a long-term condition or a limit on how they move. Classes are taught for a typical standing practice, and not every class, posture or feature will suit every body: some postures and the body setup ask you to stand, and some features rely on seeing or hearing the screen. Adapt, shorten or skip anything; use a chair, a wall or support; and practise only what is right for you. We do not assess whether a class is suitable for a particular disability or condition, so check with your clinician first where it matters. If something in Shvasa is hard for you to use, tell us: we will try to make reasonable adjustments, and the Accessibility page says what works today.
To the fullest extent the law where you live allows, you release Shvasa, its teachers, staff and contractors from claims for injury, loss or damage that arise from those ordinary risks. This release does not cover harm caused by our gross negligence, fraud or wilful misconduct, death or personal injury caused by our negligence where the law forbids excluding it, or any right the law says cannot be given up.
5. Membership, trial and payment
Some parts of the Service need a paid membership. The price, billing period, any free trial and the taxes that apply are shown before you pay. On the web, payments are processed by Stripe; we never see or store your full card details.
Buying in the iPhone app. In the app you may subscribe through Apple instead. Apple then bills you, renews and refunds under its own terms, and you change or cancel the subscription in your Apple ID settings, not on our site. The App Store price can be higher than the web price because it includes Apple’s fee; where Apple allows it, the app also links to our website to join at the web price. The membership is the same whichever way you join.
Free trial. When a plan offers a trial you have full access for the stated number of days. If a card is required, your paid membership begins and the first charge is taken when the trial ends unless you cancel before then. We show the trial end date at checkout and remind you before it ends where the law requires it.
Automatic renewal. Memberships renew automatically at the end of each billing period, and we charge the payment method on file, until you cancel. We tell you of any price change before it applies to you, and you may cancel before it takes effect.
Failed payments. If a renewal payment fails we may retry it and pause your access until it succeeds. If you dispute a charge with your bank instead of contacting us, we may suspend the account while the dispute is open.
6. Cancellation and refunds
You may cancel at any time from Membership in the account menu (or, for an Apple subscription, in your Apple ID settings). Cancelling stops the next renewal; your membership stays active until the end of the period already paid for and then ends. There are no refunds or credits for partly used membership periods: the free trial is how you try Shvasa before paying. By starting a membership you ask us to provide the Service immediately and agree that, where a statutory cancellation period would otherwise apply, it ends once the Service has started. We always refund where we charged you in error or where the law where you live requires it. Programs sold on their own may be refunded within 14 days if none of their classes has been started; events follow the rules on each event page and in Cancellation and refunds.
7. How we choose your classes
Shvasa’s teachers keep a curriculum of levels and use it to choose your classes. Your place in it is a teaching choice made by our teachers, not something you pick, and not a certificate, a qualification to teach, or a medical or fitness assessment; we do not show it as a score. From time to time a teacher asks to see a class: an ordinary class you may practise with your camera on so they can see how your practice is going. Using the camera is your choice, given each time; without it, the teacher decides from your practice. An AI model reviews the recording and a teacher may review it too; only a teacher changes your place in the curriculum. We may change the curriculum; your placement is never lowered because you missed practice.
8. The camera, measurements and faces
The camera features are optional and you choose each one: a class a teacher asks to see, framing and measuring yourself on the mat in the iPhone app, and recognising the adults who practise with you. Measurements are estimates for sizing the camera frame and the teaching, not medical or anatomical findings. Face recognition runs only on your phone, only after you agree, and only for adults who have agreed themselves (see the Privacy Policy, “Biometric information”). You agree not to point the camera at, record, name or let the app remember anyone who has not agreed, or anyone under 18, and you are responsible for having that agreement.
9. Reminders and messages
You agree that we may send you notices about your account, payments, safety and changes to these Terms by email or in the Service, and that these satisfy any legal requirement for written notice. Reminders and news are separate, each your choice, and you can turn them off at any time.
10. Our content and your licence
Classes, programs, videos, voices, scripts, photographs, text, designs and software are owned by Shvasa or its licensors and protected by copyright and other laws. While your membership or purchase is active we give you a personal, non-exclusive, non-transferable, revocable licence to stream them for your own practice. You may not copy, download (except where we provide a download), record, screen-capture, redistribute, publicly perform, sell, sublicense or make derivative works from them; scrape or bulk-collect them; or use them to train, test or improve any software or AI model.
11. What you give us
You keep ownership of what you provide, such as profile details and any recording you choose to make. You give us a licence to store, process and show it only as needed to run the Service for you, as the Privacy Policy describes. Recording, use for training, publication and social sharing each need your separate permission; none is assumed. If you send us ideas or feedback, we may use them freely without paying you or naming you.
12. Acceptable use
You agree to follow the Acceptable Use policy. In short: Shvasa is for your own practice; do not share your account, misuse our content, interfere with the Service, or involve anyone under 18.
13. Copyright complaints
If you believe something in the Service infringes your copyright, write to the support address shown in your profile with your contact details, the work, where it appears in the Service, a statement that you believe in good faith the use is not authorised, a statement under penalty of perjury that your notice is accurate and that you own or may act for the owner, and your signature. We remove material that infringes and close the accounts of repeat infringers.
14. Other companies’ services
The Service relies on others: Google and Apple for sign-in, Stripe and Apple for payments, Apple for AirPlay, Apple Health and the App Store. Their own terms apply to your use of their services, and we are not responsible for them.
15. If you use our iPhone app
These Terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content. Your licence to the app is to use it on Apple devices you own or control, as the App Store’s Usage Rules allow. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies to it, you may notify Apple, which will refund the app’s purchase price, if any; to the fullest extent the law allows Apple has no other warranty obligation, and any other claim, loss or cost from a failure to meet a warranty is ours to the extent these Terms do not exclude it. We, not Apple, handle any claim about the app, including product liability, failure to meet a legal or regulatory requirement, consumer protection or privacy law, and any claim that the app or your use of it infringes someone’s intellectual property. You confirm that you are not in a country under a United States embargo or designated as supporting terrorism, and are not on a United States list of prohibited or restricted parties. Questions and complaints about the app go to us at the support address shown in your profile. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to the Service
We may add, change or withdraw classes, programs, teachers and features. If content you booked or bought is withdrawn we will tell you and offer an alternative or a refund. If we end the Service or a paid plan, we refund any prepaid, unused portion.
17. Ending or suspending accounts
You may close your account at any time from your profile or by writing to the support address shown in your profile. We may suspend or close an account that breaks these Terms, belongs to someone under 18, puts others at risk, is used fraudulently, or where the law requires it; where fair we will warn you first and give you a chance to put things right. Sections 4, 10, 11, 13 and 17 to 22 continue to apply after your account ends.
18. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. To the fullest extent the law allows we exclude all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error-free or produce any particular result for your body or health.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, profits, revenue or goodwill, and our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability or consumer right that cannot be limited by law.
19. Your responsibility to us
To the extent the law allows, you will compensate us for claims, losses and reasonable costs (including legal fees) brought by others that arise from your breach of these Terms, your misuse of the Service, or anyone you let use your account or appear in front of the camera features.
20. Resolving disputes
Talk to us first. If you have a complaint, write to the support address shown in your profile with your name, your account email and what you would like us to do. Most problems are solved this way. Neither of us may start a formal claim until 60 days after the other receives a written description of the dispute.
If you live in the United States: individual arbitration. Any dispute between you and us relating to the Service or these Terms that we cannot resolve informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court. The arbitration may be held by video or in the county where you live; we pay the filing, administration and arbitrator fees beyond what you would pay to file in court, unless the arbitrator finds your claim frivolous. Either of us may instead bring an individual claim in small-claims court, and either of us may ask a court to stop infringement or misuse of intellectual property. You and we each give up the right to a jury trial and to bring or take part in a class, collective or representative action. If this class waiver is found unenforceable for a claim, that claim goes to court and not to arbitration. The Federal Arbitration Act governs this section. You may opt out of arbitration by writing to the support address shown in your profile within 30 days of first agreeing to these Terms, saying you opt out; opting out does not affect anything else in these Terms.
Everywhere else, you may bring a claim in the courts of the jurisdiction named in section 21 or of the place where you live, and use any consumer dispute scheme available to you.
21. Governing law
These Terms are governed by the law of the jurisdiction stated in your receipt, without regard to its conflict-of-law rules. If you are a consumer, this does not take away the protection of the mandatory laws of the place where you live.
22. General
These Terms, with the documents they name, are the whole agreement between you and us about the Service. If a court finds part of them unenforceable, that part is limited as little as possible and the rest stands. If we do not enforce a right at once, we have not given it up. You may not transfer your rights under these Terms; we may transfer ours to a business that takes over the Service, and we will tell you. We are not responsible for delays or failures caused by events beyond our reasonable control. These Terms are written in English; any translation is for convenience.
23. Changes to these Terms
We may update these Terms to reflect changes to the Service or the law. The version date changes when we do, we tell you what changed, and we ask you to agree again before you practise or pay. If you do not agree, you may cancel and close your account. Earlier versions you agreed to are kept on record.
